just leaving the USA for a month would he be denied another F1 visa in order to come back? or he will never be allowed to come back even if he is not done with his studies?|||that would be up to the immigration inspector at the airport. it would be a judgement call, so it's very hard to predict, but it is a risk. however, since he's still in status as a student, he certainly could be allowed to return. on the other hand, if he's going home for some personal reason, it does give the appearance that the asylum claim was bogus to begin with, so whatever sympathy the inspector might have will drop a few levels. If he remains in the US while in status as a student, he'll have no problems at all.|||As George L says, making an asylum claim is for someone who CANNOT return to their home country for fear of persecution, jail or even death. If you return to your country then try to come back to the US, they will assume you filed an asylum application under false pretenses and can ban you from reentering the US
