Can a person who is now on OPT get deported for working illegally while on F1 visa get deported now?|||as noted, it's certainly possible to get deported for violating any visa. it's not simply up to the whim of an ICE agent, which by the way no longer exists since ICE has changed its name yet again. getting deported isn't all all that likely, under the circumstances, but it's not impossible. The jail time IG is talking about is just the usual smoke he likes to blow. that will never happen. However, if they really wanted to get rid of the person, they'd likely just revoke his status and give him voluntary departure, since that way the person deports himself and pays for the ticket.|||Anyone who violates terms of their visa is deportable. Working while on a student visa is a serious violation. It can constitute proof of visa fraud. Persons applying for student visas are required to prove they have sufficient funds for all school expenses, plus all living expenses, plus return transportation to their own country. If they got a job, it appears they committed perjury and/or fraud in applying for the student visa. Any visa fraud and/or immigration fraud is grounds for deportation and permanent bar to reentry.
If he worked while holding student visa, how did he obtain the job when he has no Social Security number? And how did he file and pay his income taxes? It looks like he has committed multiple felonies here, in addition to visa violations. If he's very lucky, he will only be deported and permanently barred from reentry. Looks like he has racked up enough felonies here to do, ooh, about 3-4 years in prison before mandatory deportation and permanent bar to reentry. Hope he's got a hard-butt ICE officer who's throws the book at him. This guy has committed multiple serious visa/immigration violations, and apparently multiple major felonies as well.|||the interview is to decide if you did work, if you worked you will be deported. Its not to decide if you get let off, its black and white, if you worked you are goin home.|||Yes, if you violate the terms of your visa you are deportable. It doesn't matter when you are caught.|||Yes, any nonimmigrant who violates status is deportable.
